Bill References & Status: HB1335 | HB1334 | SB1058
Bill Text: HB1335 | HB1334 | SB1058
Bill Purposes: HB1335 = Prohibition to Minors; HB1334 = Adds salvia divinorum and salivinorin A to Schedule V; SB1058 = Establishes Investigative committee
Current Status: Temporarily Schedule I (8.10.2009); HB1335 = Referred to JUD, referral sheet no. 4 (1.3.2009); HB1334 = Carried over to 2010 Regular Session. (5.11.2009); SB1058 = Enrolled to governor (5.7.2009)

Details
On August 7, 2009, the Administrator of the Narcotics Enforcement Division of the Department of Public Safety issued a Notice of Emergency Controlled Substance Scheduling Action. This action made Salvia divinorum and salvinorin A Schedule I controlled substances in Hawaii on a temporary basis, the maximum duration of which is unspecified in the notice. It went into effect on August 15, 2009.

There are also some bills currently going through the legislature:
HB1335 would prohibit sales of Salvia and its byproducts (they include salvinorin A) to minors under 18.  They also would require those who sell salvia and salvinorin A to use warning labels informing users of side effects.

HB1334 would add salvia divinorum and salivinorin A to Schedule V of the Hawaii controlled substances list.

SB1058 would establish a committee to investigate the effects of salvia divinorum and, on a side note, would establish a committee to investigate issues related to medical marijuana patients and laws.

So we have two bills currently in Hawaii.  Because SB1058 has been sent to the governor, I'm predicting it'll pass.  HB1335 on the other hand has not seen any action taken concerning it since January, so I don't think too much of an immediate threat, although the ban to minors I think should be supported (as opposed to use of a full out ban)

Florida banned it completely last July 2008.

yeah definitely I heard some person was planting "forests" of it over there (not sure if meant figuratively or literally)
seems a perfect place to grow it, although, then it could become invasive and take over the islands which I guess would be kinda cool but would also justify a ban for live plants and seeds...

I don't see Salvia divinorum being invasive... but I think they way things are going... that would be a good thing.
